Terms of Service

1. Acceptance of terms

RevivaPhoto ("the Service", "we", "us") is operated by Liu Wu(the legal owner of the RevivaPhoto service at revivaphoto.com), operating as a sole proprietor under the laws of the People's Republic of China. By accessing or using the Service you agree to these Terms. You also agree to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

To use the Service you must (a) be at least 18 years of age, (b) have the legal capacity to enter into a binding agreement, and (c) not be located in a jurisdiction where use of the Service is prohibited by law.

2. Description of the Service

RevivaPhoto is a digital software-as-a-service that uses mainstream AI image models from leading vendors (principally Google's Gemini image models) to colorize black-and-white and faded photographs. It is delivered entirely online: once you upload a photo, the result is generated and returned to your browser immediately. No physical goods are shipped.

We may modify, suspend, or discontinue features at any time. We do not guarantee that any specific photo will be colorizable or that results will meet your expectations.

3. Account registration & eligibility

Sign-in with Google is optional and only required to raise your monthly free allowance. You are responsible for all activity that occurs under your account and for keeping your Google credentials secure. If you believe your account has been compromised, notify us immediately at support@revivaphoto.com.

4. Billing & payment

Payments are processed by Waffo Pancake, a PCI-DSS-certified Merchant of Record. Waffo Pancake is the legal seller of record, collects and remits VAT / sales tax on our behalf, and handles all card data. You are purchasing one-time credit packs (Starter, Family, Archive) — there is no subscription, no recurring charge, and no auto-renewal. By completing a purchase you authorize a single, one-time charge for the pack you selected. You will never be charged again unless you choose to buy another pack.

The free tier provides a limited number of colorizations each month with no signup required: 1 per month for anonymous visitors, or 3 per month once you sign in with Google. To prevent abuse we apply rate limiting and assign an anonymous device identifier (see the Privacy Policy). We may change free-tier limits at any time.

5. Credits & refunds

Each purchased pack grants a fixed number of colorization credits that never expire. The following refund rules apply:

• Consumed credits are non-refundable. Once a credit has been used to generate a result, it cannot be refunded.
• Unused credits are refundable within 7 days of purchase. Email support@revivaphoto.com within that window to request a refund of the unused balance.
• Duplicate or erroneous charges are refunded in full once verified.
• Nothing in this section limits statutory withdrawal or refund rights you may have under the laws of your country of residence (for example, the EU/UK 14-day right to withdraw from a distance contract where it applies).

Refunds are issued through Waffo Pancake to the original payment method. This refund policy is also presented at checkout.

6. Acceptable use & content standards

You may not use the Service to upload, generate, or distribute any of the following categories of content, and you may not use the Service in any of the prohibited ways listed below:

Prohibited content

• Sexual or NSFW content of any kind, including sexually explicit, pornographic, or otherwise lewd material.
• Violent or gory content, including gratuitously bloody, graphic, or disturbing imagery.
• Hate speech or content that attacks or demeans a person or group based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, age, or similar protected characteristics.
• Material that sexualizes, exploits, or endangers children (including CSAM), or otherwise violates child-protection laws. We report suspected child-exploitation material to the relevant authorities.
• Deepfakes or impersonation of real, identifiable people without their consent.
• Content that infringes the intellectual property, trademark, or privacy rights of others.

Prohibited uses

• Upload content you do not have the right to use.
• Process illegal, defamatory, harassing, fraudulent, or abusive content.
• Distribute malware, run phishing campaigns, or build attack tools.
• Circumvent security or access controls.
• Resell or sublicense the Service without our permission.
• Violate any applicable law or card-network rules.
• Use AI outputs to train a competing model, scrape or harvest outputs at scale, or impersonate a licensed professional (doctor, lawyer, etc.).

Enforcement

Violations of this section may result, at our discretion and without prior notice, in removal of the offending content, suspension or permanent termination of your account, and forfeiture of any remaining credits. Where required by law we may also report the activity to the appropriate authorities. Termination for breach does not entitle you to a refund except where mandated by applicable consumer law.

Reporting violations

If you encounter content or behavior that violates these Terms, please report it by emailing support@revivaphoto.com with the subject line "ABUSE REPORT" and, where possible, a link or description of the material. We review every credible report.

Content moderation

We operate both automated filters (for example, to block known abusive inputs before processing) and a human review process for reported and flagged content. Reports are typically reviewed within 2 business days. Content that breaches this policy is removed, and repeat or severe offenders are banned. Our moderation decisions are final, but you may appeal by contacting support.

7. AI output & intellectual property

You retain ownership of the photos you upload and of the colorized results you download. By uploading, you grant us a limited, non-exclusive license to process the photo through our AI model solely to generate candidates and return them to you. We do not claim ownership of your content, and we do not use your uploaded photos or results to train our models without your explicit consent.

The colorization is produced by mainstream AI image models that we operate through our providers (principally Google's Gemini image models). Where third-party model output is involved, the generated result is provided to you for your personal and commercial use subject to these Terms.

8. Data, privacy & security

Payment card data is processed exclusively by our PCI-DSS-certified payment processor, Waffo Pancake, and is never stored on our servers. Our handling of personal data is described in the Privacy Policy. We retain account session data for up to 90 days after it is no longer needed for service delivery.

9. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. AI colorization is imperfect and results may vary. We do not guarantee that colorized results will be accurate or suitable for any specific purpose, including any legal, historical, or identification use.

To the maximum extent permitted by law, Liu Wu shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Term & termination

We may suspend or terminate your access if you violate these Terms. You may stop using the Service and request deletion of your account data at any time by emailing support@revivaphoto.com. Sections that by their nature should survive termination will remain in effect.

11. Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-laws principles. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts located in the People's Republic of China. Nothing in this section limits any mandatory consumer-protection or data-protection rights you may have under the laws of your country of residence (including the EU/UK GDPR and your local consumer laws), which apply to you regardless of this choice of law.

12. Changes to these Terms

We may update these Terms from time to time. For material changes we will give at least 14 days' advance notice by email or by a notice on the Service before the changes take effect. Continued use after changes take effect constitutes acceptance of the revised Terms.
